The fifth chapter of Crewmember Rules of PRC specially provides crewmember¡¯s education and training

and crewmember service. As crewmember serving company, crewmember dispatch enterprise should

perform the obligations.



The qualification satisfied by crewmember dispatch enterprise

Article 40 provides the definition and qualification of crewmember serving company. Crewmember

dispatch enterprise shall not only meet the qualification and be approved by the competent Maritime

Safety authority, but also acquire operation qualification for dispatching crewmember abroad.

Crewmember dispatch enterprise should regulate routines



According to Crewmember Rules of PRC, Crewmember serving company shall found crewmember files,

strengthen to manage crewmember, master crewmember¡¯s qualification, safety record, health situation

and so on. In addition, it should submit the materials for recording in the competent maritime safety

authority. Crewmember serving company should publicize its serving items and charge standards.

Crewmember dispatch enterprise should perform obligations when crewmember conclude labor contract

If crewmember is dispatched on ship flying five-star and red flag, the ship owners is employer, who

should conclude labor contract with crewmember. If crewmember is dispatched on ship flying foreign flag,

the crewmember dispatch enterprise is deemed to the employer, who should conclude labor contract

with crewmember.
